Acceptance

By requesting a quote, approving a proof or placing an order with InstaPrints, you agree to these terms. They apply alongside our Privacy Policy, Cookie Policy, Refund & Reprint Policy and Shipping & Turnaround page.

Quotes and orders

Written quotes are valid for 30 days unless stated otherwise and assume print-ready artwork. Prices shown on this website are starting prices for the configurations described and are not binding offers. An order is accepted when we confirm it in writing and receive the agreed payment or deposit.

Artwork and proofs

You are responsible for the content and accuracy of the artwork you supply, including spelling, phone numbers, prices, dates and layout. We issue a free digital proof for every order; production begins only after your written approval. Once a proof is approved, errors within it become the customer's responsibility. Color on a monitor will differ from printed output; commercially reasonable color variation of up to 10% is normal and is not a defect.

Intellectual property

You confirm that you own or are licensed to use all text, images, logos and fonts you supply, and you indemnify InstaPrints against claims arising from their use. We will refuse work that appears to infringe rights or that is unlawful, defamatory, or intended to deceive. Designs we create remain our property until paid for in full, at which point ownership of the final artwork transfers to you.

Quantities and tolerances

Trade practice allows a production variance of up to 5% over or under the ordered quantity on runs above 1,000 pieces; you are invoiced for the quantity delivered. Cutting tolerance is +/- 0.0625", and fold and bindery tolerance is +/- 0.125".

Payment

New customers pay in full at order. Approved commercial accounts may be offered Net 15 terms. Late balances accrue interest at 1.5% per month or the maximum permitted by New York law, whichever is lower. Applicable New York State sales tax is added unless a valid exemption certificate is on file.

Cancellations

Orders may be cancelled before proof approval for a full refund less any design time already spent. After approval, you are responsible for materials consumed and labour performed to that point. Custom dies, plates and special-order stock are non-refundable once purchased.

Turnaround and delivery

Production times are quoted in business days and start the business day after proof approval and payment clear. We are not liable for carrier delays, weather events, equipment failure or other circumstances outside our reasonable control. Risk of loss passes when goods are collected by you or handed to the carrier.

Storage of finished goods

Completed orders held at our request are stored free for 30 days. After 60 days uncollected, we may invoice storage or dispose of the goods, and the balance remains payable.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim is limited to the amount you paid for the affected order. We are not liable for indirect, incidental or consequential damages including lost profits, lost opportunities or costs of postponed events.

Governing law

These terms are governed by the laws of the State of New York. Any dispute will be brought in the state or federal courts located in Albany County, New York.

Changes

We may update these terms. The version in force is the one published on this page at the time your order is accepted.
